[it, en] Massa, processo “Scripta scelera”: assoluzioni e una condanna a 8 mesi per vilipendio del presidente della Repubblica

OPERAZIONE SCRIPTA SCELERA: ASSOLTI GLI ANARCHICI IMPUTATI NEL PROCESSO DI MASSA PER LA PUBBLICAZIONE DI “BEZMOTIVNY”. UNA CONDANNA A 8 MESI PER OFFESA ALL’ONORE O AL PRESTIGIO DEL PRESIDENTE DELLA REPUBBLICA

L’8 aprile 2025 è stata emessa la sentenza del processo con giudizio immediato in corso a Massa contro quattro compagni anarchici inquisiti per la pubblicazione del quindicinale anarchico internazionalista “Bezmotivny” (operazione repressiva dell’8 agosto 2023). Gli imputati – coinvolti nell’operazione assieme ad altri sei inquisiti per cui il procedimento è rimasto nella fase di indagine – erano accusati di istigazione a delinquere e apologia di reati e delitti di terrorismo (art. 414 c. p., commi 1, 3 e 4) con la circostanza aggravante della finalità di terrorismo (art. 270 bis 1 c. p.), per la pubblicazione della sessantina di numeri di “Bezmotivny”, e di offesa all’onore o al prestigio del presidente della repubblica (art. 278 c. p.), in merito a un articolo specifico (“Soffiare sul fuoco”, pubblicato in “Bezmotivny”, anno I, numero 17, 25 ottobre 2021).

Tutti gli imputati sono stati assolti per l’accusa di istigazione a delinquere pluriaggravata “perché il fatto non sussiste”, mentre il solo Luigi è stato condannato a 8 mesi, senza l’applicazione della recidiva reiterata, per offesa all’onore o al prestigio del presidente della repubblica (gli altri tre imputati sono stati assolti anche da quest’accusa “per non aver commesso il fatto”). È inoltre stata negata la richiesta risarcitoria dell’avvocatura dello Stato.

Al termine della requisitoria tenutasi nell’udienza precedente del 1º aprile, il pubblico ministero Manotti della Direzione Distrettuale Antimafia e Antiterrorismo di Genova aveva richiesto 7 anni di carcere per Gino, 6 anni per Luigi (con la revoca della sospensione della pena per una precedente condanna comminatagli dal tribunale di Ravenna) e 5 anni e 6 mesi a testa per Gaia e Paolo, mentre l’avvocatura dello Stato per la presidenza del consiglio dei ministri aveva richiesto un risarcimento di mezzo milione di euro.

OPERATION SCRIPTA SCELERA: ACQUITTED THE ANARCHISTS ACCUSED IN THE TRIAL OF MASSA FOR THE PUBLICATION OF ‘BEZMOTIVNY’. AN 8 MONTH SENTENCE FOR OFFENSE TO THE HONOUR OR PRESTIGE OF THE PRESIDENT OF THE REPUBLIC (ITALY)

On April 8th, 2025, the verdict was handed down in the trial ongoing in Massa against four anarchist comrades indicted for the publication of the internationalist anarchist fortnightly ‘Bezmotivny’ (repressive operation of August 8th, 2023). The defendants – who were involved in the operation together with six other comrades for whom the proceedings remained at the investigation stage – were charged with incitement to commit crimes and apologia of crimes and offences of terrorism (art. 414 of penal code, paragraphs 1, 3 and 4) with the aggravating circumstance of the purpose of terrorism (art. 270 bis 1, penal code), for the publication of the about sixty issues of ‘Bezmotivny’, and of offence to the honour or prestige of the president of the republic (art. 278, penal code), concerning a specific article (‘Soffiare sul fuoco’, published in ‘Bezmotivny’, year I, issue 17, October 25th, 2021).

All the defendants were acquitted of the charge of multiple aggravated incitement to commit crimes ‘because the fact does not exist’, while only Luigi was sentenced to eight months, without the application of recidivism, for offending the honour or prestige of the president of the republic (the other three defendants were also acquitted of this charge ‘for not having committed the fact’). The request for compensation by the State attorney’s office was also denied.

At the end of the indictment held at the previous hearing on April 1st, public prosecutor Manotti of the DDAA (‘Anti-Mafia and Anti-Terrorism District Directorate’) of Genoa had requested 7 years’ imprisonment for Gino, 6 years for Luigi (with the revocation of the suspended sentence for a previous conviction imposed on him by the court of Ravenna) and 5 years and 6 months each for Gaia and Paolo, while the State attorney for the presidency of the council of ministers had requested compensation of half a million euro.
